A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On October 31, 2008, the Defendant was sentenced to a summary order of KRW 1 million at the Ulsan District Court for fraud; on February 12, 2009, to a fine of KRW 1.5 million for fraud at the Suwon District Court for fraud; on February 17, 2009, the Defendant was sentenced to a fine of KRW 1 million at the Ulsan District Court for habitual fraud; on March 18, 2011, the Defendant was sentenced to a summary order of KRW 1 million at the Suwon District Court for fraud; on March 23, 2011, the Defendant was sentenced to eight months of imprisonment at the Suwon District Court for fraud; on October 11, 2011, the execution of the sentence was terminated; and on January 12, 2012, the Defendant was sentenced to a fine of KRW 2 million from the Suwon District Court for fraud.
1. At around 00:50 on April 11, 2013, the Defendant: (a) discovered and delayeding the victim E (manam and 42 years of age) from a D pharmacy located in Ulsan-gu C, Ulsan-gu; (b) laid down the victim’s hand on the part of the victim’s money; (c) cut off the 60,00 won in cash; (d) one of the 60,000 won in cash and one of the victim’s names in the victim’s name; (e) one of the 60,000 won in cash and one of the son’s credit cards (G).
2. Violation of the Specialized Credit Finance Business Act;
A. On April 11, 2013, the Defendant issued an order for alcohol and alcohol at the H station located in Ulsan-gu, Ulsan-gu, Seoul on April 11, 2013, the Defendant used a stolen credit card by presenting one SK card under the name of E, as described in the foregoing paragraph 1, to an employee in his/her name, and paying 180,000 won at the alcohol price.
B. On April 11, 2013, the Defendant committed the crime of 01:35 on April 11, 2013, at the main point indicated in the above paragraph (a) around 01:35 on April 11, 2013, the Defendant used stolen credit cards by presenting oneSK card under the name of E, as described in the above paragraph (1), to the employees in the name of his/her address, and paying 10,000 won with the tobacco value.
C. On April 11, 2013, the Defendant committed the crime of 02:23 on April 11, 2013, on the part of the Defendant: (a) 02:23 on April 11, 2013, she boarded a taxi operated by a taxi engineer under his/her name in Ulsan-gu I, Ulsan-gu; and (b) stolen it as described in the foregoing paragraph (1).
