A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. On March 1, 2014, at around 03:35, the Defendant: (a) cut off a cre in which the victim D was under the influence of alcohol from the corridor of the first floor B, Dongdaemun-gu Seoul Dongdaemun-gu, Seoul, the first floor of B; and (b) cut off one lock, which is the victim’s possession of another victim; and (c) one lock, where the market price cannot be known.
2. Fraud;
A. On March 1, 2014, at around 03:41, the Defendant purchased one freezing and one live number at the G convenience store operated by the victim F in the first floor of Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, and settled KRW 3,150,00 by presenting the stolen name D K card as Defendant’s card to employees who are unaware of the fact, as described in paragraph (1).
Accordingly, the defendant, by deceiving the victim, acquired financial benefits equivalent to the market price of 3,150 won.
B. On March 1, 2014, around 04:26, the Defendant, at the main point of the JJ operated by the victim I located in Seongbuk-gu Seoul Seongbuk-gu Seoul, 400,000 won was settled three times in total by suggesting the victim who was aware of the fact that he was the Defendant’s card.
Accordingly, the defendant, by deceiving the victim, acquired economic benefits equivalent to the market value of 400,000 won.
C. At around 06:20 on March 1, 2014, the Defendant purchased 1, 1, 1, and 1, etc. at the convenience store operated by the victim L in Dongdaemun-gu Seoul, Seoul, and presented 7,650 won to the employees who knew of the fact as if he was the Defendant’s card.
Accordingly, the defendant, by deceiving the victim, acquired financial benefits equivalent to the market price of 7,650 won.
3. On March 1, 2014, the Defendant was not authorized to use computers, etc., with one SK card in the name of D, which was stolen, as described in paragraph (1), at the store located in the new line of the subway No. 1 located in Dongdaemun-gu Seoul Metropolitan Government, Dongdaemun-gu.
