A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
On November 29, 2011, the Defendant was sentenced to two years of imprisonment for a period of six months for fraud in Daegu District Court and racing support, and the judgment becomes final and conclusive on December 7 of the same year, and is still under suspension of execution.
1. At around 12:30 on March 8, 2013, the Defendant discovered that: (a) the victim F was placed in the front corridor of “E Child Care Center” located in Changwon-si, Changwon-si; (b) one cellular phone with a market price of at least 10.80,000 won; (c) one half of half of the market price of 200,000,000 won; (d) one copy of the IBK’s card; (e) one driver’s license; and (e) one copy of the IBK card; and (e) one credit card (f) the victim’s surveillance was neglected; and (e) by taking advantage of the gap in the victim’s surveillance, the Defendant stolen goods of at least 1.35,500,000 won.
2. Fraud;
A. On March 8, 2013, the Defendant acquired money equivalent to the same amount from the victim I, the convenience store owner, by presenting the stolen card to an employee as if he/she was his/her card, within the H convenience store located in Changwon-si G, Changwon-si, the Defendant purchased goods equivalent to KRW 32,500, from the H convenience store located in Changwon-si, Changwon-si, 2013.
B. At around 13:01 on March 8, 201, the Defendant, as seen above, obtained money equivalent to the same amount from the victim by presenting a new F-owned card to the Defendant, the victim, as if he was his card, at the Kelter located in the Changwon-si, Changwon-si, Masan Branch: (a) and by making a settlement of accommodation charges of KRW 30,000; and (b) making a contribution to the room 205.
3. The Defendant violated the Specialized Credit Financial Business Act, at the time, place, and so on, the stolen credit cards were used unlawfully.
4. On March 8, 2013, the Defendant attempted to commit fraud: (a) around 13:26, 2013, at the Nururter in Changwon-si M, Changwon-si; (b) as seen above, the Defendant presented F-owned cards to Mour business owners, who were victims, as if they were his carded, accommodation charges 35.
