Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. 피고인은 2018. 1. 3. 22:50 경 수원시 장안구 B에 있는 ‘C’ 주점 여자 화장실에 이르러, 열린 출입문을 통해 위 화장실 안으로 침입한 후 피해자 D( 여, 가명, 23세) 가 사용하는 용 변 칸을 향하여 스마트 폰 카메라 촬영 버튼을 누르고 칸막이 위로 스마트 폰을 올려 피해자가 용변을 보는 모습을 촬영하고자 하였으나 이를 눈치챈 피해자가 화장실 칸막이를 세게 두드리자 급히 도망하는 바람에, 피해자의 모습을 제대로 촬영하지는 못하였다.

Accordingly, the Defendant attempted to take the victim’s body against his will, which might cause sexual humiliation or shame, into the public use place used by many and unspecified persons, such as toilets, for the purpose of meeting his own sexual desire.

2. On January 3, 2018, at around 23:00, the Defendant came into a female toilet with the second floor of the building E in Suwon-si, Suwon-si, Seoul Special Metropolitan City, via an open entrance, and came into a side column of the common screen used by the victim F (F, name, 19 years old), and taken a photograph of the victim by putting the smartphone camera photographer on the smartphone, and then raising the smartphone on the upper part.

Accordingly, the Defendant, as seen above, intruded into the public use place used by many and unspecified persons, such as toilets, with a view to meeting his own sexual desire, and taken the victim’s body against his will that may cause sexual humiliation or shame.
