A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Performance of official duties or injury;

A. 다. 피고인은 2014. 7. 12. 00:00경 위 나항과 같이 현행범인 체포되어 대구 서구 F 소재 C지구대 사무실에서 조사를 위하여 대기하던 중 경위 D의 얼굴을 향하여 침을 뱉고, 지구대 사무실에 가래침을 수회 뱉으면서 “씨발놈아 개새끼야”라고 욕설을 하는 등 소란을 피우고, 같은 지구대 소속 경위인 피해자 G(56세)로부터 제지를 당하자 “이 씨발놈은 또 뭐고”라고 욕설을 하면서 발로 피해자 G의 정강이 부위를 2회 걷어 차 피해자 G에게 약 2주간의 치료가 필요한 다리 부위 옅은 손상의 상해를 가하였다.
