A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"2019 Highest 128"
1. On November 30, 2018, the Defendant: (a) on November 30, 2018, but did not take necessary measures, such as acquiring a new physical check card lost by the victim D and returning it to the owner in front of the Cridge.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Fraud and the Defendant violated the Specialized Credit Financial Business Act: (a) around December 1, 2018, at the “G convenience store” operated by the Victim F in Seocheon-si, 09:28, the Defendant presented the new physical fitness card acquired as stated in the foregoing paragraph (1), as if he was his card, to the victim as if he was his card, and had the victim received goods equivalent to KRW 4,500 of the market price from the victim; and (b) around that time, until December 16:02, 201, the Defendant received goods worth KRW 97,300 in total over 16 times in total, as indicated in the attached Table 1, and illegally used the stolen physical card.

1. On January 29, 2019, the Defendant: (a) obtained one credit card card from an I bank lost by the victim H in the vicinity of the Seocheon-ro, Seocheon-ro, Seocheon-do; (b) did not take necessary measures, such as returning the acquired property to the victim; and (c) did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. The Defendant who attempted to larceny from around January 30, 2019
1. From 31.14:25 up to the date of cash withdrawal administered by the victim I Bank, Inc., Ltd., the victim I Bank established at the Dong branch of the I Bank in Busan-si J, Busan-si, and collected the credit cards of H I Bank, as described in paragraph 1 above, and received a short-term card loan service three times in total, and did not receive a password error.
Accordingly, the defendant tried to steal the victim's property and attempted to commit it.
