전화금융 사기 조직( 이하 ‘ 보이스 피 싱 조직’ 이라 한다) 은 전화를 이용하여 불특정 다수의 피해자에게 전화를 걸어 거짓말로 피해자를 속여 계좌로 돈을 이체 받거나 금융감독원 등 국가기관을 사칭하면서 피해자들의 금융거래정보가 유출된 것처럼 피해자들을 속여 이를 방지하기 위한 조치인 것처럼 피해자들 로 하여금 돈을 인출하게 한 후 이를 교부 받아 가는 소위 ‘ 보이스 피 싱’ 방법으로 범행을 하는 조직으로서, 불특정 다수의 피해자들에게 전화를 거는 ‘ 콜센터’, 피해 자로부터 현금을 전달 받는 ‘ 현금 수거 책’, 현금 수거 책으로부터 돈을 전달 받는 ‘ 전달 책’ 등으로 각 역할을 분담하고 있고, 검거에 대비하여 수사기관의 추적이 곤란한 속칭 ‘ 대포 폰’ 등을 이용하거나 중국 모바일 채팅 어 플인 ‘ 위 챗 (wechat)’ 등을 이용하여 서로 연락하는 등의 점조직 형태로 운영되고 있다.
