A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. The Defendant posted on September 14, 2014 a letter that “I would sell a heavy cell phone” on the Southern-gu E/Gu, 102 dong 1404, and then sent a cell phone to the victim F who reported and contacted the above letter “I will forward KRW 90,000 to the victim F, first of all, remittance of KRW 90,00.”

However, even if the defendant receives the above money from the victim, he did not have the intention or ability to send the goods.
