A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2014 Highest 3569] On July 29, 2013, the Defendant made a false statement to the effect that the victim C reads a letter posted to the effect that “the purchase of heavy cell phones” is made on the Internet Niberian bulletin board and made contact with the victim to deliver the cell phone at the time of transfer of money.”

However, the defendant did not have a heavy cell phone so that he did not have any intention or ability to sell money even if he received money from the victim.

The Defendant received 30,000 won from the victim to the post office account (D) in the name of the Defendant for the same day as the price of goods.

From around that time to March 25, 2014, the Defendant received a total of KRW 869,500 by the same method over ten times from the jurisdiction of the city in Busan Metropolitan City, as shown in attached Table 1, among the crimes committed in attached Table 1.

Accordingly, the defendant was provided property by deceiving the victims.

[2014 Highest 4710] On March 9, 2014, the Defendant sent a false statement to the victim E, who posted an Internet NAV (www.naver.com)’s bulletin board, stating that he/she would sell the Korean cultural master book at KRW 55,00,00, and then received KRW 55,000 from the victim’s account in the name of the Defendant.

Accordingly, the defendant was given property by deceiving the victim.

[2014 Highest 4803] On March 19, 2014, the Defendant posted an article stating that he/she would purchase 5S from the Internet NAVL bulletin, even though he/she did not have a NAS mobile phone and did not intend or have ability to sell it even if he/she did not receive the price, he/she made a false statement that he/she sold a mobile phone after contact F with the victim F who posted it on the Internet NAV bulletin board.

The defendant is against the victim.
