A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On August 30, 2012, the Defendant was sentenced to one year of imprisonment for fraud at the Incheon District Court on August 30, 2012, and completed the enforcement of the sentence at the Incheon Detention House on May 4, 2013.

"2015 Highest 176"

1. On November 5, 2014, around 16:38, 2014, the Defendant posted a false statement to the effect that he/she would send money to the victim E who reported and contacted the above writing, by accessing the Internet NAVV “China” camera bulletin board, and selling a heavy and high-priced vehicle.

However, there was no intention or ability to send the thing.

As such, the Defendant, by deceiving the victim, received 60,000 won from the victim via the account of the Defendant’s community credit cooperatives (Account Number:F) at the time of such deception, and acquired a total of 3,750,000 won from that time to December 17, 2014, as shown in attached Table (1), by remitting the total of 8,750,000 won from that time.

2. Violation of the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (information and communications network infringement, etc.) on November 14:40, 2014, the Defendant entered the ID and password of the victim G NA who provided and purchased money from the victim G G NA in Gyeyang-gu Incheon, and connected to the NAV Kafa, thereby infringing on the information and communications network without any access authority, and entered the attached list (2) from the City to December 17, 2014. However, the victim “I” No. 5 appears to be a clerical error in the “J”.

In a total of eight times, the information and communications network was invaded without access authority.

On July 8, 2014, the Defendant, “2015 Highest 331,” posted a letter “assigning a heavy cell phone,” and sent money to the victim H, who reported and contacted the above letter, by accessing the Internet NAVV bulletin board with no intent or ability to sell a mobile phone.”
