A defendant shall be punished by imprisonment for two years.

Seized evidence subparagraphs 1 through 6 above shall be confiscated from the defendant.

Punishment of the crime

[criminal power] On April 12, 2012, the Defendant was sentenced to six months of imprisonment with prison labor for night building intrusion theft at the Seoul Northern District Court (Seoul Northern District Court). On August 17, 2013, the Defendant completed the execution of the sentence at the port prison.

1. 특수절도 피고인은 2014. 1. 30. 20:00경 경기도 성남시 분당구 C 소재 피해자 D의 집에 이르러, 피해자가 설 명절로 집을 비운 틈을 타 인근에 있던 대리석 벽돌을 주워 창문을 깬 다음 안방으로 침입하여 그 곳에 있던 피해자 소유의 현금 150만원, 시가 합계 1,180만 원 상당의 반지 7개, 시가 합계 1,400만 원 상당의 목걸이 5개, 시가 200만 원 상당의 샤넬 귀걸이 1개 등 시가 합계 2,930만 원 상당의 재물을 가지고 갔다.

From around that time to September 26, 2014, the Defendant: (a) destroyed part of the structure at night as shown in attached Table 1; and (b) invaded on the victim’s residence or building at night; and (c) stolen the property worth KRW 297 million in total and KRW 7,000 on a total of six occasions.

Accordingly, the defendant stolen property by damaging the door, the wall, and a part of the structure at night, and by impairing the residence or structure of the victims.

2. On January 30, 2014, at around 19:04, the Defendant attempted to larceny property by opening and intrusioning the window after opening the window at the same place by using the cresh in which the victim F located in Seongbuk-gu, Seongbuk-gu, Seongbuk-do, Seongbuk-do, was located. However, the Defendant failed to commit such attempted theft because the window was not opened.

From around that time to November 7, 2014, the Defendant attempted to steals property by destroying part of the structure at night, as shown in the attached Table 2, and by impairing the residence or structure of four victims over a total of four occasions, but attempted to commit an attempted crime.

Accordingly, the defendant damages part of the door, the wall, and other structures at night.
