1. The Defendant: (a) KRW 117,019,481 to the Plaintiff; and (b) KRW 5% per annum from October 15, 2017 to February 13, 2019 to the Plaintiff.
Reasons
1. Facts of recognition;
A. Status 1) The Plaintiff is the deceased C (hereinafter “the deceased”).
2) The Defendant is a co-inheritors’s spouse, who is a co-inheritors, agreed to separately inherit the full amount of the damage claim of the deceased against the Defendant. 2) The Defendant is a person who operates the F Hospital located in Sinju-si E (hereinafter “Defendant Hospital”).
B. At around 12:00 on October 11, 2017, the Deceased was exposed to 3-hour Abscopic gas, and showed symptoms out of frozen and frozen after being exposed to an emergency room at around 17:26 on the same day, and was hospitalized in the Defendant Hospital at around 18:45 on the same day, and was discharged on October 13, 2017 due to no special visit in blood tests and chest X-ray.
C. 3) On October 15, 2017, the heart examination executed around October 14, 2017 with respect to the deceased at the first time in the instant case, which was conducted on or around October 14, 2017, did not have any special opinion, and the blood examination-related numerical value (CK-MB, Topon-T) and the numerical value related to the acute heart was confirmed to be normal. 4) The medical personnel in the Defendant hospital notified the deceased of his visit to the emergency medical personnel in the Defendant hospital at around October 15, 2017, and released the deceased again upon the aggravation of symptoms.
