Reasons
Punishment of the crime
The Defendant and B purchased the lost portable phone, which the victims gets on the taxi, to resell it, and B purchased the lost portable phone from the taxi driver by skeing the name from the street, and the Defendant offered to resell it after passing it.
1. B, around 01:00 on October 3, 2012, sent a signal to the effect that a cell phone is purchased on the street near the exit of the Hong-gu Seoul Mapo-gu Hong-gu Seoul Metropolitan Government on his hand and then sent the signal to the effect that a cell phone is purchased by scaming it by means of scaming, and then purchased at KRW 50,000,000,000 from a taxi driver on his name, who is the victim C that he embezzled, in awareness of the fact that he is a stolen price of KRW 9,00,000,000,000,000,000,000 won, even though he was aware of the fact that the victim’s non-scam is a stolen price of KRW 9,00,00,000,000
2. B, at around 02:00 on October 4, 2012, at the same place as Paragraph (1) and in the same manner as Paragraph (1), purchased 100,000 won from the victim D, who he embezzled from a taxi driver on his name, and the victim E-owned market price of KRW 900,000,00,000, in awareness of the fact that galgal lus are stolen, and the Defendant acquired stolen goods from B.
3. B, around October 4, 2012, around 03:20, purchased 130,000 won from the taxi driver G with knowledge of the fact that the value of 4S 1,000 won from the victim H, he embezzled from the taxi driver G in the same manner as Paragraph 1, at the front of Mapo-gu Seoul Metropolitan Government, and the Defendant acquired stolen goods from Defendant B.
Accordingly, the defendant acquired five cell phone units with a total of 4.5 million won in collusion with B, with knowledge of fact that they are stolen goods.
