Punishment of the crime

피고인은 성명 불상( 위 챗 대화명 ‘C’) 등 공범들과 중화 인민 공화국( 이하 ‘ 중국’ 이라 함) 내에 일명 ‘ 콜센터 ’를 설치한 다음, 전화 유인책들 로 하여금 연락처 등 개인정보가 저장된 데이터 베이스를 이용하여 무작위로 전화를 걸어 검사나 검찰청 수사관 등을 사칭하여 피해자들이 범죄에 연루된 것처럼 기망하고, 금융감독원 직원을 사칭하여 피해자들을 찾아가 그들 로부터 직접 현금을 교부 받은 방식의 범행( 이하 ‘ 보이스 피 싱 범행’ 이라고 한다) 을 순차 모의하였다.

위와 같은 범행 모의에 따라 보이스 피 싱 조직의 총책인 일명 ‘C’ 는 전화 유인책 관리 등 보이스 피 싱 범행을 총괄하며 현금 수거 책에게 구체적인 범행을 지시하는 역할을, D은 위 챗 대화명 ‘E'( 가명 : F) 을 사용하며 위 C가 운영하는 중국 사무실에 서 보이스 피 싱 피해 금 수거 책을 모집하는 전화 상담원 역할을, 보이스 피 싱 조직의 전화 유인책인 성명 불상자는 중국에 위치한 일명 ‘ 콜센터 ’에서 국내의 불특정 다수의 피해자들에게 전화를 걸어 계좌에서 현금을 인출하여 수거 책에게 전달하도록 유인하는 역할을, 수거 책인 G, H, I, J,
