A defendant shall be punished by imprisonment for two years.
Seized evidence Nos. 1, 2, 6 through 45 shall be forfeited from the accused.
Reasons
Punishment of the crime
From November 201 to July 2015, the Defendant purchased Chinese counterfeit goods from Chinese manufacturers of counterfeit goods through C, D (E), etc. at a lux in the Chinese mine (hereinafter “E”), and carried them into the Republic of Korea. The Defendant is a person who has kept two containers in G Logistics Center located in F at the time of the Gyeonggi Culture and Arts, one container warehouse in H at the time of the Gyeonggi Sports Promotion, one container warehouse in the International Logistics Center located in H at the time of the Gyeonggi Sports Promotion, one container warehouse in the Korea Logistics Center located in J at the same city, and one container warehouse in the Korea Logistics Center at the same city and operated by the Defendant, and supplied it to Lerer and retailers of counterfeit goods across the country.
피고인은 2011. 11.경부터 2015. 7. 26.경까지 위 각 창고 등지에서 위와 같이 중국으로부터 밀반입한 위조 상품, 즉, 상표권자인 프랑스 ‘루이비똥 말레띠에’사, ‘샤넬’사, ‘구치오구치쏘시에떼퍼아찌오니’사, 룩셈부르크 ‘프라다 에스.에이’사, ‘보테가 베네타 인터내셔널. 에스.에이.알.엘’사, 프랑스 ‘고야드 쌩-또노레'사, ’지방시‘사가 각각 대한민국 특허청에 그 지정상품을 가방, 지갑 등으로 정하여 등록한 ‘루이비똥(LOUIS VUITTON)', '샤넬(CHANEL)', '구치(GUCCI)', '프라다(PRADA)', ’보테가 베네타(BOTTEGA VENETA)', '고야드(GOYAD)', '지방시(GIVENCY)'와 동일ㆍ유사한 상표가 부착표시된 가방 약 7,000점, 지갑 약 13,000점(정품 시가 합계 약 244억 원 상당)을 국내 도소매상들에게 판매하여 1억 5,700만 원의 수익(가방 1점 당 평균 마진 15,000원, 지갑 1점 당 평균 마진 4,000원)을 올리는 영업을 하고, 2015. 7. 27. 위 각 창고 및 위 승용차 내에서 위와 같이 판매하고 남은 별지 범죄일람표 기재와 같은 위조 가방, 지갑 등 28,367점(정품 시가 271억 2,790만 원 상당)을 판매할 목적으로 보관하였다.
