A defendant shall be punished by imprisonment for not less than eight months.

피고인은 종업원 F과 함께 2015. 1. 초순경부터 2015. 4. 1.까지 위 매장에서 상표권자인 룩셈부르크 `프라다 에스.에이.`사가 대한민국 특허청에 그 지정 상품을 가방 등으로 정하여 등록한 ‘프라다(PRADA)'와 동일유사한 상표가 부착된 가방 22점(정품시가 2,220만 원 상당)을 판매하고, 2015. 4. 1. 14:33경 위 매장에서 별지 범죄일람표 기재와 같이 상표권자인 영국 ‘버버리리미티드’사, 프랑스 ‘해르메스앵떼르나씨오날’사, 룩셈부르크 ‘보테가베네타 인터내셔널 에스.에이.알.엘’사, 이탈리아 ‘에트로에스.피.에이’사, 룩셈부르크 `프라다 에스.에이.`사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사, 미국 ‘리버 라잇 브이,엘.피.’사, 프랑스 ‘고야드 쌩-또노레’사가 각각 대한민국 특허청에 그 지정 상품을 가방, 지갑, 키홀더, 벨트 등으로 정하여 등록한 '버버리(BURBERRYS)', ‘해르메스(HERMES)’, ‘보테가 베네타(BOTTEGA VENETA)', ’에트로(ETRO)', ‘프라다(PRADA)', ‘구치(GUCCI)’, '토리버치(TORYBURCH)', ’고야드(GOYARD)'와 동일유사한 상표가 부착된 가방, 지갑, 키홀더, 벨트 등 총 46점(정품시가 35,842,000원 상당)을 판매 목적으로 보관하고, 위조 철제상표 32점을 위조상표 제작에 사용할 목적으로 소지하였다.

Accordingly, the defendant, in collusion with the above F, infringed the trademark rights of the above trademark right holder.
