Punishment of the crime

[2013 High Court Decision 2342] The Defendant is the believers belonging to the C church in Yangcheon-gu Seoul Metropolitan Government, and the victim E, F, G, and H are the believers belonging to the I of the same church.

The Defendant, who is a member of the C church, was detained on suspicion of misconduct, was divided into “D” opposing J pastors and “I” supporting J pastors in relation to the measures of succession and normalization of the church, etc., and published a letter that defames victims by borrowing the form of a novel appearing on the Internet portal website following the Internet portal site where the unspecified number of believers can access and inserting a letter that slanders the victims who are the opposite believerss belonging to “I”.

On August 14, 2012, at around 23:55, the Defendant described the Victim G in charge of the church parking lot station located on the above bulletin board as “a stage in which L and parking lots are loaded as if they were each one’s own land.” From that time, from March 27, 2013 to March 18:04, the Defendant publicly distorted the victims by referring respectively to “M, N, L (O), and P,” while referring to the names and descriptions of victims as shown in the “crime list” from March 27, 2013, as it is similar to the names and descriptions of victims, but as it refers to “M, N, L (O), and P,” the victims’ duties, occupation, etc. inside the church, were committed various misconducts in the church.

C교회의 ‘D’ 측이 운영하는 인터넷 포털 사이트 다음의 ‘K’ 카페(K)에 ‘Q’이라는 닉네임으로 접속한 후 위 사이트 게시판에 “R이여 돌아오라~~!!”라는 제목으로 별지'R에 대한 게시글' 기재와 같은 글을 게시함으로써 공연히 피해자 R을 모욕하였다.
