A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant is not a narcotics handler.

1. On March 2020, the Defendant, while searching on the Internet, came to know of a person who was unable to use a telephone name “B”, which is a sales book of telephones (i.e., a single-name hereinafter referred to as “philphones”), and intended to purchase a telephone from the above person who was unaware of the name.

On May 28, 2020, the Defendant: (a) deposited 400,000 won in a bank account in the name of F (Account Number: G) designated by the winners of his name in the “D Bank E” located in Osan City, Osan-si; (b) on May 28, 2020, the Defendant purchased and sold the penphone in a manner of getting from the 0.5g of the penphone, which is a place delivered by the winners of his name, on May 28, 2020.

B. On June 8, 2020, at around 21:26, the Defendant deposited 40,000 won without passbook in the same manner as described in the above paragraph (a) at the place indicated in the above paragraph (a). On June 8, 2020, the Defendant purchased and sold phiphones by means of getting 0.5g of the phiphonephone, which is the place delivered from the person who was absent from his name, at around 2:30, June 8, 2020.

C. On June 11, 2020, at around 22:45, the Defendant deposited 400,000 won without passbook in the same manner as the above paragraph (a) at the place indicated in the above paragraph (a). On June 11, 2020, the Defendant traded a philopon using a philopon with a prior hidden 0.5g of a philopon, which is a place delivered by an unqualified person on the second floor of the Seocho-gu Seoul Yang Jae-dong, Seoul, at around 23:30 on June 11, 2020.

On June 13, 2020, at around 20:42, the Defendant deposited 40,000 won in the same manner as described in the above paragraph (a) at the location described in the above paragraph (a), and traded phiphones by means of getting 0.5g of the philopon, which is the place delivered from a person without his name, on June 13, 2020, at around 21:30, the place of delivery from a person with no name, Seocho-gu, Seoul Metropolitan Government Yang Jae-dong's address in the second floor, where the person without name was hidden in advance.
