1. The defendant shall be punished by imprisonment for a period of two years and six months;

2. Provided, That the above sentence shall be executed for three years from the date this judgment becomes final and conclusive;

Punishment of the crime

The defendant is not a person handling narcotics.

1. Import of narcotics smuggling;

A. On March 29, 2020, while the Defendant experienced difficulties in restaurant business operated by the Defendant, the Defendant asked B, located in the U.S., to send the hemp plant to Korea on March 2020. At that time, B, upon the Defendant’s request, sent the hemp plant to the Republic of Korea. At that time, B, upon the Defendant’s request, stored the hemp plant, stored approximately 1g of general tobacco, stored the hemp plant coloned with the hemp plant, stored the hemp plant, stored the hemp plant as an international special air transport cargo, then then sealed the addressee A, received, entered it in Busan Metropolitan City-gu C apartmentD, and TEL E.

Since then, around March 29, 2020, the International Air Transport Cargo concealed by the hemp plant arrived at the Incheon Central Port located in Jung-gu Incheon Metropolitan City, Jung-gu, Incheon, and the Defendant received it at the Defendant’s residence on March 31, 2020.

Accordingly, the Defendant imported approximately 1g of hemp in the United States as the Republic of Korea.

B. On May 3, 2020, the Defendant requested the above B to send the hemp plant to the police officer on April 3, 2020. B upon the Defendant’s request, the Defendant removed five general tobacco colons of the hemp plant, stored approximately 5g of the hemp plant colons, stored approximately five g of the hemp plant colons, stored them together with the hemp plant, stored them in an international air transport cargo, and then sent the addressee A, the destination of which was entered into the Busan Metropolitan City’s annual C ApartmentD and TEL E.

Then, around May 3, 2020, the International Air Transport Cargo concealed by the hemp plant arrived at the Incheon central supply port located in the Jung-gu Incheon Metropolitan City, Jung-gu, Incheon, and the Defendant received the hemp plant through his mother G at the Defendant’s residence around May 6, 2020.

Accordingly, the Defendant imported approximately 5g of hemp in the United States as the Republic of Korea.

C. On June 4, 2020, the Defendant: (a) requested the Defendant to send the hemp plant to the Defendant on May 2020; and (b) received the Defendant’s request from the Defendant, the Defendant removed the coloned tobacco coloned in seven parts of general tobacco, and the Defendant removed the coloned tobacco coloned in seven parts of the hemp plant.
