A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is not a person handling narcotics.
1. The Defendant conspired with D residing in the U.S. to import hemps into Korea by using international express postal items. Accordingly, D, around January 28, 2013, sealed approximately 3g of hemps into the ground bed, sealed it into the ground bed, and then the addressee was indicated as “A” and “B”, and sent the name by reporting it to the ground beer, etc. on January 31, 2013, and then sent it to the aircraft concealed in the Incheon Republic of Korea’s port of supply located in the Jung-gu Incheon Metropolitan Government, Jung-gu, Incheon, and caused the addressee to arrive in the aircraft concealed in the ground bed.
Accordingly, the Defendant conspiredd with D to import approximately 3g of hemp plants.
2. On February 23, 2013, around 2013:30, the Defendant smoked marijuana by taking tobacco smoke from the Defendant’s residence at the above E-building 401, and taking approximately 0.5g of the hemp plants imported as described in the above paragraph (1), one smoked.
3. On February 20, 2013, at around 20:00, the Defendant smoked marijuana by taking tobacco smoke from the Defendant’s residence at the building No. 401, and taking approximately 0.5g of the hemp plants imported as described in the foregoing paragraph (1), for which he/she had the same tobacco smoked.
4. The Defendant again requested D to send the hemp plant to Korea, and D agreed to import the hemp plant into Korea by accepting it.
Accordingly, D around 12:57 May 7, 2013, after inserting approximately 9.52 g of hemp into the ground beer beer in plastic bags at Kent Posington City, and packing it into the ground beer, and then filing and sending the name of the addressee as “A,” G 303 of the Gwangju Metropolitan City Mine-gu, Gwangju Metropolitan City, “A,” the delivery site, and reporting the name as the ground beer, etc., at around 16:45, May 10, 2013, it is an international express postal item concealed by the hemp at the above Incheon State’s delivery port.
