A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Notwithstanding the absence of the qualification to handle narcotics, the Defendant handled the marijuana as follows:
1. Trade in marijuana;
A. On August 7, 2019, the Defendant purchased hemps by collecting approximately 1g of hemp plants contained in disposable vinyl finyl chloride, which A left and left in front of the toilet Radi, located in Gwangju Mine-gu, and by remitting KRW 120,000 from the Defendant’s bank account in the name of the seller A (D) from the Defendant’s bank account at around 15:57.
B. On January 15, 2020, the Defendant: (a) intended to purchase about 2 g of marijuana from a seller of the hemp plant on his/her name using smartphone telephone grams; (b) transferred KRW 2.10,000 from the Defendant’s new bank account to the NAC’s account used by the seller of the hemp plant; and (c) received the location and photograph of the hemp from the seller of the hemp to the NAC’s account used by the seller of the hemp; and (d) purchased the hemp by using approximately 17-18 km away from G in Gwangju-gu, Gwangju; and (e) purchased approximately KRW 7,50,000,00 of the hemp by using his/her own seat on the blocking installed on the side side of the roadside at the same night of the same day, from that time, five times as indicated in the list of crimes.
2. Smoking marijuana;
A. On August 7, 2019, the Defendant: (a) at the H room parking lot in Gwangju Mine-gu, Gwangju; (b) removed consular leaves contained in one cigarette; (c) added approximately 0.5g of hemp plants at that place; and (d) smoked the hemp in such a way as to inhale the smoke.
B. On August 8, 2019, the Defendant appeared as above.
In the same place as this paragraph, approximately 0.5g of the hemp plant was smoked in the same manner.
C. On January 20, 2020, the Defendant was above the Defendant around 15:00.
At the same place as this paragraph, approximately 0.5g of the hemp plant was smoked in the same manner.
The defendant at around 20:00 on January 21, 2020 above A.
In the same place as this paragraph, approximately 0.5g of the hemp plant was smoked in the same manner.
