1. Defendant I: (a) with respect to Plaintiff H KRW 9,942,090 and KRW 1,000,000, among them, KRW 9,942,090.
Reasons
1. Facts of recognition;
A. The Plaintiffs are the respective Dong representatives of the instant apartment that are members of the council of occupants’ representatives (from February 1, 2012 to January 31, 2014), and the Defendants are the occupants of the instant apartment.
B. Around September 2012, the Defendants and the council of occupants’ representatives (such as disputes between the Defendants and Defendant I, and assault and bodily injury to Plaintiff H) committed a crime of occupational embezzlement, etc. relating to the instant apartment construction in collusion with the Management Director at the Office of Management, and the Plaintiff A, who was the Vice-Chairperson, was in charge of the president’s position through a special election on November 2012, and the head of the Management Office was replaced on January 13, 2013. (2) On the basis of the result, the Defendants visited the Management Office from around February 13, 2013 to inspect and examine relevant materials, such as the details of the instant apartment construction, the execution of management expenses, etc., by visiting the Management Office, and by holding a resident’s general meeting on May 2, 2013, reported the excessive management expenses and construction expenses, ② the result of examining the details of unlawful payments, ③ the proposal for dissolution, and the resolution of the management committee on May 28, 2013.

On June 8, 2013, the Defendants informed the bulletin board of each entrance entrance of each of the five apartment units in the instant case and inside the elevator that “the process of proposing the dismissal of the council of occupants’ representatives with respect to apartment management fees and excessive imposition and collection of construction costs” as the title “the management rules scheduled to be amended are arbitrarily altered, and the contents of the execution concerning the excessive imposition and collection of construction costs have been discovered, as the management rules are excessively imposed on the management fees and the excessive imposition and collection of construction costs.”
