이에 C의 어머니인 피해자 D(여, 56세)이 차에서 내려 피고인에게 항의하자 피고인은 피해자 D에게 C, C의 조카들, 행인 등이 있는 자리에서 “니 년이나 내 년이나 니미 보지 같은 년아! 알아서 가 봐라.”고 욕설을 하면서 배를 피해자의 몸에 수 회 들이밀고, 팔짱을 낀 상태에서 팔꿈치로 피해자의 입술 부위를 1회 쳤다.
