피고인은 2014. 8. 22. 15:50경 군산시 C빌딩 앞길에서 피해자 D(여, 39세)이 E 에쿠스 승용차를 운전하다가 약국에 들르기 위해 편도 2차로 중 2차로에 정차하자 자신이 운전하던 F 화물차량을 위 승용차 앞쪽에 정차한 후 차에서 내린 다음, 위 승용차 운전석에서 앉아 있던 피해자에게 다가와 “이런 씹할 년, 죽여 버린다, 이 개같은 년아, 왜 차를 도로에 대냐, 쳐 죽여 버린다.”라고 큰소리로 윽박지르고, 차에서 내린 피해자에게 오른쪽 주먹을 들어 때릴 듯이 수 회 휘두르며 ”이 씹할, 좆 같은 년, 때려 죽인다, 이 씨발년아, 신고 해, 신고하면 죽여 버릴 테니까 신고해.”라고 말하면서 피해자를 협박하였다.
