A defendant shall be punished by imprisonment for three years.
However, the execution of the above sentence shall be suspended for a period of five years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On February 1, 2017, the Defendant: (a) around 02:27, to import from D’s residence located in Seongdong-gu Seoul Metropolitan E Apartment Complex 106 704 dong 704 with D in a foreign country; (b) received KRW 1 million from D to the Nong Bank account (F) in which the Defendant uses; and (c) received the remainder of KRW 500,000 from D in cash.
Around that time, the Defendant connected to the overseas web site “G” and ordered KRW 50,000 of the paper LSdididi, and transferred the name-based and non-coin account in which the sales books of narcotics are used in Canada, and entered the residence address of the above D as LSdi delivery paper.
D around March 8, 2017, at the residence of the above D around March 8, 2017, through the above online order of the defendant, the non-member of the above name was concealed in ems international postal items and received LSD 50 points dispatched from Canada.
2. On March 1, 2017, the Defendant decided to import from D with D at the residence of the said D, LSDD 1,500, and received 10,000 won check and 5 million won check from D.
Around that time, the Defendant connected to the above “G” and sent approximately KRW 4.110,000 to the bitco account used by the above Defendant, and entered the residence address of the said D with LSdi delivery branch.
D around March 27, 2017, at the house of the above D, the following persons received ELS D 1,500 points sent from Canada by concealing in the ems international mail by the Defendant’s online order.
Accordingly, even though the Defendant was not a handler of narcotics in collusion with D, the Defendant imported a total of 1,550 points of ELS 1,550, a local mental medicine in Canada, in the Republic of Korea.
