1. The defendant shall pay to the plaintiffs the amount of money stated in the "personal fee" in the separate sheet No. 1, and as to this, July 2008.

Reasons

1. Basic facts

A. The Plaintiffs, who were employed by the Defendant and worked as street cleaners, was all retired prior to June 30, 2008, as street cleaners belonging to the Korean Federation of Labor Unions, the Korean Federation of Labor Unions (hereinafter “the instant trade union”).

B. The instant trade union to which the Plaintiffs belong and the Defendant concluded each collective agreement in 2006 and 2008, and the contents of the collective agreement concerning wages, working conditions, etc. are as follows.

(1) Article 14(1) of the Collective Agreement of 2006 (Conclusion of July 27, 2006) (1) The daily working hours of partners shall be eight hours from July 1, 2005 to forty hours a week.

Article 15 (Flexible Holidays) A shall conduct paid holidays falling under any of the following subparagraphs:

Provided, That 150 pactes shall be paid to members who work on a holiday.

[hereinafter] Article 17 (Annual Leave) "A" shall pay annual leave or allowance to "B" as follows:

(1) “A” shall grant 15 days’ paid leave to a person who has worked at least 80 percent of one year.

(2) "A" shall grant one-day paid leave to any member who has been employed for less than one year on a one-month basis.

(5) A "A" shall grant a person who has worked for not less than three consecutive years a paid leave of not less than one day for each two consecutive years of continuous employment in excess of the first one year during the leave referred to in paragraph (1).

In such cases, the total number of leave days, including additional leave, shall not exceed 25 days.

(6) The conditions of application for annual paid leave may, where the number of working days exceeds the prescribed number of working days in the preceding year, receive the annual paid leave of the fixed number of working days for the following year.

Article 18 (Wage and Welfare) (1) All wages of members shall be paid within budgetary limits in accordance with the "Standards for the Compilation of the Budget for Deputy Employment for Environmental Unified Workers" and the collective agreement.

(2) Members shall engage in overtime work due to inevitable circumstances.
