A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, without any particular occupation or income, was able to obtain a normal loan from a financial institution with his own credit alone, by providing high-amount service fees to the fraudulent loan groups, such as B, C, and D, and by forging a certificate of employment, etc. and submitting it to the financial institution.
1. Around September 10, 2008, the Defendant: (a) consented to the fabrication of private documents; (b) the Defendant provided the Defendant with personal information, such as his/her resident registration certificate, etc., at the office located in Gwangju-gu, Gwangju-gu; and (c) submitted a certificate of employment to the effect that he/she works for burcs; and (d) the Defendant submitted a tax withholding receipt for wage and salary income to the effect that his/her annual income is KRW 39,468,800, using a editing device, such as a burc, etc.; and (c) submitted it as if he/she did not know the name of the Defendant at the victim burc branch located in Gwangju-gu, Gwangju-gu, Gwangju-gu, the private document on fact-finding; and (d) forged a certificate of employment in the name of burcs; and (e) forged a receipt of tax withholding for wage and salary income; and (e) submitted it as if he/she could not know the name of the Defendant’s.
Accordingly, the Defendant, in collusion with the above B, C, and D, forged a certificate of employment in the name of Ban C&C Co., Ltd. and one copy of a tax withholding receipt for wage and salary income, respectively.
2. On September 10, 2008, according to the above public invitation with B, C, and D, the Defendant is unable to identify the documents related to the loans, including the documents in the name of PelbC Co., Ltd., which was forged as above, at the victim bank Gwangju-ro 5-ro 152 around September 10, 208.
