A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2019 Highest 3416"

1. No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number;

Nevertheless, at around 09:30 on March 23, 2019, the Defendant received medical treatment by notifying the employees of the hospital located in the name in Eunpyeong-gu Seoul Metropolitan Government “D” of the resident registration number of E (F) by the health insurance policyholder. The Defendant was determined by the stroke-m (hereinafter “stroke-m”), which is a psychotropic drug, and used the stroke-m (hereinafter “stroke-m”) more than nine times in total from around that time to May 14, 2019, as indicated in the attached list of crimes (1).

With respect to this part of the list of crimes which were originally prosecuted, the prosecutor was notified of the decision to dismiss the prosecution as a result of the modification of the indictment to delete it.

2. No person who commits fraud or any violation of the National Health Insurance Act shall receive insurance benefits by fraud or other improper means;

Nevertheless, the Defendant received insurance benefits equivalent to KRW 68,240,00 in total in an unlawful manner by allowing the National Health Insurance Corporation to receive insurance benefits under the name of the victim, as stated in the attached Table (1) Nos. 1 through 6, as well as receiving medical treatment by allowing Dong name, who is a health insurance policyholder, to receive a stroke-type E in order to be prescribed by the above stroke-type method at the time and place as mentioned in paragraph (1) above, and obtained financial benefits equivalent to the same amount by allowing the victim to receive insurance in the name of the victim.

3. The Defendant is not a person handling narcotics, etc.

Nevertheless, the Defendant, at the time and place specified in the above Paragraph 2, imitate E, as above, purchased at least three times in total, such as the attached list (1) 1 through 6, with a prescription of 84 times at stroke-m, and entered in the indictment as 'six times' in the indictment.
