A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Resident Registration Act;

A. On April 2, 2019, at around 08:55, the Defendant: (a) indicated D’s resident registration number as D and received treatment from the physician E, and (b) unlawfully used another’s resident registration number by purchasing a stroke (i.e., a “stroke-m”; hereinafter “stroke-m”) 28 psychotropic drugs with a prescription in the name of D.

B. On April 22, 2019, around 14:40 on April 2, 2019, the Defendant was given medical treatment to doctors E as if he was one’s own F, and used another’s resident registration number unlawfully by purchasing 21 shares via a prescription in the name of F.

2. Violation of the National Health Insurance Act;

A. The Defendant received insurance benefits in an unlawful manner by having the Defendant pay 20,884 won, in the name of medical expenses and medicine expenses, when purchasing a stroke-mm via which the completion of the work at the same time and place as that mentioned in paragraph 1(a) was conducted as if she were D and was issued a prescription for treatment.

B. The Defendant received insurance benefits in an unlawful manner by having a sum of KRW 21,604 in the name of medical expenses and medicine expenses, when purchasing a stroke-mm via which the Defendant completed the examination and treatment at the same date, time, and place as indicated in Paragraph 1(b), and issued a prescription as if he were F.

3. Despite the fact that the Defendant is not a person handling narcotics, etc., the Defendant administered 49 times via a stroke-m as referred to in paragraph (1) in a way that, at intervals of two to three days between Apr. 2, 2019 and Apr. 2, 2019, approximately seven stroke-m with water at the Defendant’s dwelling located in Gwangju Mine-gu G at intervals of two to three days.

The Defendant, around 12:40 on December 5, 2019, shall drive a passenger car and Gwangju.
