A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a foreigner of Vietnamese nationality.

1. On January 2019, the Defendant: (a) reported an advertisement posted “D” at the Defendant’s residence located in Dongdaemun-gu Seoul, Dongdaemun-gu; (b) forged Vietnam’s driver’s license without legitimate acquisition, via C; and (c) had the intent to exchange it with the domestic driver’s license.

Accordingly, the Defendant requested C to produce Vietnam's driver's license under the name of the Vietnam Transportation Bureau, which is a part of the documents required for the issuance of the Korean driver's license in contact with C, and sent the passport, alien registration certificate, certificate of entry into and departure from Korea, old day certification photographs, etc., together with fees of KRW 7.40,00,00. C received the above documents from the Defendant and sent them to E who is a brorder for the forgery of Vietnam's driver's license. E made the Defendant a fake driver's license under the name of the Vietnam Transportation Bureau (F) in an unsound manner, and C sent the Defendant a fake driver's license to the Defendant by drying, and the Defendant submitted it to the Defendant on January 17, 2019.

Accordingly, the Defendant, in collusion with C and E, forged a driver's license in the name of the Vietnam Transport Bureau against the Defendant, a private document regarding a certificate of fact, and exercised it.

2. On January 17, 2019, the Defendant of obstruction of performance of official duties by fraudulent means is legitimate to close Vietnam driver's license for the forged Defendant, who was delivered by C to the person in charge of issuing the foreigner's license under the name-free statement that knew of forgery at the driver's license test site of the above Seodaemun-do.
