A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 2, 2012, the defendant is a woman of Vietnam who is staying in the Republic of Korea as a national spouse (F-6) after entering the Republic of Korea with his husband who is a Korean husband.

1. In order to obtain “exchange Issuance” as Korean driver’s license even though there is no Vietnam driver’s license, the Defendant paid fees to Vietnamese B, who arranged the forgery of Vietnamese driver’s license, and received forged Vietnames driver’s license, and applied for “Exchange Issuance” at the domestic driver’s license test site to obtain a domestic driver’s license.

On October 2018, the Defendant: (a) requested the manufacturing of a Vietnam driver’s license to B, who became aware of the fact that the Defendant was issued a driver’s license in Vietnam, in order to exchange the Defendant’s domestic driver’s license in Vietnam; (b) paid KRW 750,00,00 for the Defendant’s entry and departure certificate, Vietnam identification card, passport, and alien registration certificate; and (c) requested the forgery of the above B’s name in his name to use the forged driver’s license in a false manner; and (d) around October 18, 2018, the Defendant sent the Vietnam driver’s license to a foreign employee in charge of the issuance of the counterfeit driver’s license, who was aware of the counterfeit fact, along with an application for the replacement of the driver’s license, as seen above, and submitted the forged driver’s license to the employee in charge of the issuance of the foreign driver’s license.

As a result, the Defendant, in collusion with B and a person in poor name, forged a driver's license in the name of the Vietnam Traffic Bureau against the Defendant, a private document regarding a certificate of fact, and exercised it.

2. On October 18, 2018, the Defendant of fraudulent means’s obstruction of performance of official duties shall issue a foreigner’s license under the name-free statement at the place of the driver’s license test of the above provision.
