A In four months of imprisonment, Defendant B shall be punished by a fine of KRW 1,500,00, Defendant C shall be punished by a fine of KRW 2,00,00, and Defendant D.

Punishment of the crime

1. 피고인 A 피고인 A은 2014. 3. 26.경 서울 강서구 K에 있는 자신이 운영하는 ‘L’ 잡화점에서 상표권자 ‘루이비똥말레띠에’가 등록한 상표(등록번호 제0118012호)와 동일한 모양의 위조 상표를 부착한 가방 5점을 판매하기 위해 소지하여 위 상표권자의 상표권을 침해한 것을 비롯하여, 그 무렵부터 2015. 5. 17.경까지 별지 범죄일람표(2) 별지 범죄일람표의 ‘팔라스’, ‘라킷’, ‘메티스’, ‘아찌’, ‘모듈신상’, ‘네오’, ‘몽데뉴’, ‘가죽뽀찌’, ‘토탈리’, ‘발미’ 등은 모두 위 각 상표권자들의 가방을 지칭하는 명칭이다.

The same shall apply to both paragraphs (3) through (8) of the crime sight table against the other Defendants.

In order to sell a forged trademark of the same shape as the trademark registered by two trademark owners over seven times, such as the description, the trademark right of each trademark owner was infringed by holding in order to sell a forged trademark of the same shape and a mobile phone case 12.

2. Defendant B: (a) around December 26, 2013, Defendant B possessed the trademark right of the said trademark right holder in order to sell the bags 6 points identical to the trademark (registration number No. 0118012) registered by the trademark right holder at the Nangu Gag-gu Ma 101 on an “N” restaurant operated by himself/herself (No. 018012), Defendant B infringed on the trademark right of the said trademark right holder by carrying in possession to sell the forged trademark on two occasions from around that time to June 27, 2014, as shown in the List of Crimes (3).

3. Defendant C: (a) around January 15, 2014, at his/her own house located in the Hongcheon-gunO of Gangwon-do, Defendant C possessed the trademark right infringement of the said trademark right holder by carrying at his/her own house in order to sell the forged trademark of the same shape as the trademark (registration number No. 0118012) registered by the trademark right holder; and (b) eight points on the wall.
