A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant violating the Trademark Act is a person who operates a household product manufacturing and selling company with the trade name “D” from the 1st floor of Seocheon-gu, Seocheon-gu, Seocheon-si C.

피고인은 2013. 12. 16.경 상표권자 ‘루이비똥말레띠에’가 등록한 상표(등록번호 제0118012호, 제0631194호)와 동일한 모양의 위조 상표가 부착된 가방 7점, 휴대폰 케이스 10점을 소지하던 중 위조상품도매업자 E으로부터 665,000원을 받고 위 E에게 이를 판매한 것을 비롯하여, 그 무렵부터 2015. 7. 9.경까지 위 상표권자 ‘루이비똥말레띠에’가 등록한 상표(등록번호 제0118012호, 제0631194호)와 동일한 모양의 위조 상표를 부착한 가방 3,274점, 지갑 19점, 휴대폰 케이스 837점, 상표권자 ’구치오구치소시에떼퍼아찌오니‘가 등록한 상표(등록번호 제0132874호)와 동일한 모양의 위조 상표를 부착한 가방 33점, 상표권자 ‘샤넬’이 등록한 상표(등록번호 제0309448호)와 동일한 모양의 위조 상표를 부착한 가방 12점을 소지하던 중 별지 범죄일람표 (1) 별지 범죄일람표의 ‘아찌모노’, ‘아찌불박’, ‘신불작납짝이’, ‘메티스’, ‘팔라스’, ‘아찌’, ‘팔중’, ‘오디온’, ‘페이보릿’ 등은 모두 위 각 상표권자들의 가방을 지칭하는 명칭이다.
