1. Nevertheless, the Defendant, along with H, I, J, and K, conducted physical lease of the land to dispose of wastes without permission, and received waste disposal costs without permission from the competent authorities, and H agreed to perform the overall duties of waste disposal and fund management, the Defendant and J agreed to perform the duties of care for waste disposal, the duties of care for waste disposal, the duties of care for wastes disposal, the duties of care for wastes storage, and the duties of care for waste storage truck, and the duties of care for on-site management, such as access control of waste transport trucks, respectively.
According to the aforementioned division of roles, the Defendant leased the factory site of Cheongju-si, Cheongju-si, L owned by L, under the name of the Defendant. From that time to November 22, 2018, the Defendant collected and stored wastes by allowing waste collection and transportation business entities to dumping approximately KRW 7,750 tons of commercial wastes on the said site.
Accordingly, the Defendant, in collusion with H, I, J, and K, discarded commercial wastes at a place other than a place or facility installed to collect wastes, and operated a waste disposal business without obtaining permission from the competent authorities.
