[Defendant A] The defendant shall be punished by imprisonment for one year.

However, for two years from the date this judgment becomes final and conclusive, the above sentence shall be executed.

B is a corporation whose purpose is the construction business of water supply and sewerage systems, and the defendant A is the representative director of the above corporation.

1. A person who intends to engage in the business of collecting, transporting, recycling, or disposing of wastes of Defendant A shall obtain permission from the competent authority, and no one shall dump wastes in any place, other than a place or facility prepared by the competent authority for the collection of wastes, and no one shall dump excreta, livestock excreta, dead bodies of animals, wastes, or sludge into public waters without justifiable grounds;

Nevertheless, on January 12, 2019, the Defendant, without obtaining a license for waste disposal business as above, laid off the relevant dredging vehicle owned by C, a general waste recycling business entity, with a total sum of 3,236,380 kms in the same way as shown in the separate sheet of crime, from that time until May 24, 2019, the F box located in G, Kimhae-si, which is a sewage pipe connected to the river and used for public use.

As a result, the Defendant carried out a waste disposal business without obtaining permission, and performed an act of dumping wastes into public waters without justifiable reasons at the same time with the waste disposal in a place other than a place or facility prepared by the competent authorities to collect wastes.

2. The Defendant B, a representative director of the Defendant, carried out waste disposal business without obtaining permission for the Defendant’s business at the time and place specified in paragraph (1), and, at the same time, throw away wastes into public waters without justifiable grounds at places and facilities other than those prepared by the competent authorities to collect wastes.
