Reasons
Punishment of the crime
The Defendants shall not abandon commercial wastes in any place other than those prepared by the Special Self-Governing City Mayor, Special Self-Governing Province Governor, the head of a Si/Gun/Gu, or the manager of a facility, such as a park or a road, in order to collect wastes, and any person who intends to engage in the business of collecting, transporting, recycling, or disposing of wastes shall have facilities, equipment, and technical capacity in accordance with the standards prescribed by Ordinance of the Ministry of Environment, and any person who intends to engage in the business of collecting, transporting, recycling, or disposing of wastes in any type of business
1. Defendant A’s crime - The Defendant, along with D, E, and F, conspired to engage in the illegal waste disposal business without permission from the Minister of Environment, to use the land for dumping wastes without permission, and to use the land for the illegal waste disposal business without permission from the Minister of Environment. D, while engaging in the illegal waste disposal business without permission from the Minister of Environment, planned to take charge of the overall business instruction and fund management of the waste disposal business, E, and the Defendant and F, in charge of the business related to waste disposal, on-site management, such as the access control of the truck for waste transport.
Around September 11, 2018, the Defendant, along with D, E, and F, leased land equivalent to 5,524 square meters of H-owned land in the name of E, namely, I, J, K, L, etc., from September 20, 2018 to October 4, 2018, the Defendant collected and stored waste by having C and other waste transportation business entities collect and keep the same from September 20, 2018, drum-250 and 637.5 tons of waste synthetic resin containing designated wastes among the industrial wastes (based on non-point 0.2).
As a result, the Defendant, in collusion with D, E, and F, thrown away commercial wastes from places or facilities other than those prepared to collect wastes.
