1. The plaintiff's claim is dismissed.

1. Facts of recognition;

A. 1) The Plaintiff’s wife B concluded an insurance contract between the Plaintiff and the Defendant on February 14, 2003 (hereinafter “instant insurance contract”) with the Defendant using the insured as the Plaintiff and the beneficiary of disability benefits as the Plaintiff, the contract amount of KRW 10 million.

(2) The main contents of the instant insurance contract are as follows.

Article 12 (Types of and Grounds for Payment of Subsidy Insurance Money) (1) A communications agency shall pay the insurance money agreed upon to the beneficiary when any of the following events occurs to the insured during the insurance period:

Payment for disability benefits: Grade 1: 20%, Grade 3: 10%, Grade 4: Grade 5: Grade 30%, Grade 5: Grade 30%, Grade 6: Grade 1: Grade 20%, and Grade 6: Grade 1 of the physical disability in the attached Table 2 (Disaster Classification Table) due to the conditions of disability of Grades 2 through 6 in the disability classification table as specified in attached Table 3 (hereinafter referred to as "grade 1") or due to the disasters as specified in attached Table 2 (Disaster Classification Table);

1. Where the eyesight of both eyes has lost completely;

2. When he completely loses the function of horse or chewinging;

3. Where he/she is required to leave a serious obstacle to his/her heavy health, alert or mental health and to be provided lifelong nursing services at all times.

4. When he/she is required to have a clear disability in the long-term of chest and clothes left so that he/she can all times undergo a lifelong nursing, the disability classification table (based on disability grade classification).

(a) disability defined in the definition of disability refers to the state of permanent mental or physical damage that remains in body due to a fixed symptoms, even though sufficient medical treatment was provided for an injury or disease caused by a disaster, but not completely recovered;
