1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On August 10, 1999, the Plaintiff’s mother B entered into an insurance contract with the Defendant for non-dividend children (hereinafter “instant insurance contract”) with the following contents. The terms and conditions applicable to the instant insurance contract are as follows.
Type of insurance: The insured policyholder B: The insured period from August 10, 199 to August 10, 2014: The beneficiary from August 10, 1999 to August 10, 2014: The beneficiary at the maturity of B, the Plaintiff at the time of injury, and the inheritor at the time of death, Article 12(Insurance Clause (Insurance Money) of the Insurance Contract at the time of death of the insured.
3. When the insured becomes disabled in Grades 2 through 6 in the disability classification table among the disability status table of Grades 1 among the disability grade table specified in the attached Table 3 during the insurance period period: (1) The insured may choose to pay rehabilitation treatment funds in addition to the lump-sum payment under Article 25 (Payment of Insurance Money) (1) the insured may choose to pay the whole or part of the insurance money under Article 12 (Grounds for Payment of Insurance Money) (1) 2 in accordance with the business method of the company as provided for in the business method of the company.
[Attachment 1] When the insured becomes disabled in Grades 2 through 6 of the Disability Classification Table due to a disability or a disaster of grade 1 in the insurance period subject to the payment of insurance money - The following amount shall be 10% of the annual amount of the disability grade (based on the amount of insurance covered under contract) paid every 20 years from the date on which the cause for the payment of insurance money occurs, 10% of the annual amount of the disability grade 1, 2, 3, 4, 5, 6,
3. Rehabilitation treatment funds (Article 12 (1) 3 of the Terms and Conditions), attached Table 3, physical disability Grade I of the disability classification table;
3. Nursing at all times shall be provided to ensure that there is a clear obstacle to the medium-term care, alert or mind.
