A defendant shall be punished by imprisonment with prison labor for up to six months.
Reasons
Punishment of the crime
1. On January 29, 2016, the Defendant was sentenced to imprisonment with prison labor for a violation of the Military Service Act by the Daejeon District Court on January 29, 2016, and the execution of the sentence was terminated on November 9, 2016. On August 16, 2018, the Incheon District Court sentenced eight months of imprisonment with prison labor for fraud, etc., and the judgment was finalized on August 24, 2018.
On January 1, 2018, the Defendant sent a false statement to the “CPC bank” located in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, to the effect that “D” was connected with the online game using a computer and sold “one million won of the game money” at the entire holding room of the said game, and that the Defendant sent a false statement to the victim E who reported and contacted the foregoing.
However, even if the defendant received KRW 100,000 from the victim, he did not have the intention or ability to pay the game money.
Nevertheless, the Defendant deceiving the victim as above and transferred KRW 100,000 to the F Bank Account (Account Number: G) in the name of the Defendant around 06:15 on the same day from the victim.
In addition, the Defendant received KRW 2,300,000 from the victims three times in total, as shown in the list of crimes, from January 24, 2018, from that time by the above method.
2. On March 15, 2018, the Defendant sent a false statement stating that “The Defendant shall send a game money if he/she deposits KRW 120,000 to an known account,” to the victim H, who reported the fact that he/she visited “D” online and sold “1,500,000,000 won of the game money” in the total holding room of the said game.
However, even if the defendant received 120,000 won from the victim, he did not have the intention or ability to pay the game money.
Nevertheless, the Defendant, as above, by deceiving the victim as above, obtained 120,000 won from the victim to the J bank account in the I name at around 18:16 of the same day.
