Defendant shall be punished by a fine of KRW 3,000,000.

Punishment of the crime

1. 피고인과 B의 공동범행 피고인과 B는 공모하여, 2017. 12. 16.경 의왕시 C 소재 D PC방에서 E에서 운영하는 인터넷 게임 F에 B의 아이디로 접속한 후, 게임머니를 많이 보유하고 있는 것처럼 그림판을 통해 위조한 스크린샷을 게재하며 위 게임 채팅창 확성기를 통해 게임머니 판매 의사를 표시하고, 이를 보고 연락한 피해자 G에게 ‘돈을 입금하면 게임머니를 주겠다.’라고 거짓말을 하였다.

Ultimately, as seen above, the Defendant and B, by deceiving the victim as above, received KRW 105,00 from the victim’s account in the name of the Defendant (H) to transfer the amount of KRW 105,00,00 from around that time to October 10, 2018, and acquired the money by remitting the total amount of KRW 1,177,100 as the price for game money through 11 times as shown in attached Table 4.

2. Around March 21, 2018, the Defendant’s sole criminal criminal defendant connected the Internet Game F operated by JPC room located in Ansan-si, and falsely stated that he/she expressed his/her intent to sell the said game money through his/her loudspeaker, and that he/she would pay the money to the victim K who reported and contacted with this intent.

However, even if the defendant has received the payment from the victim, he did not have the intent or ability to pay the game money.

Ultimately, the Defendant, by deceiving the victim as above, received KRW 150,00 from the victim’s account in the name of the Defendant (L) and received KRW 150,00 from the above time to March 25, 2018, and acquired it by deceiving the victim seven times as shown in the attached crime sight table 6, such as the following from around that time to March 25, 2018.
