A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

[2019 Highest 1770] On January 29, 2019, the Defendant posted a false statement to the effect that he/she sells online game money by accessing the “L” at the French site, and reported the false statement to the victim M who visited the victim “to send L Game money if he/she deposits KRW 40,000.”

However, even if the defendant received money from the victim, he did not have the intention or ability to sell the game money.

Nevertheless, the Defendant, by deceiving the victim as above, received 40,000 won from the victim to the company bank account under the name of the Defendant for the same day as the money in the game money in the same day, and by deceiving 84 victims from January 29, 2019 to February 17, 2019, and by deceiving 12,731,250 won in total as the sales proceeds of the game money in the name of the victim.

[2019 Highest 2032] On February 2, 2019, the Defendant posted a false statement to the effect that he/she sells online game money by accessing the “L” to the “On-the-counter game,” and the Defendant made a false statement to the victim N who contacted the “to send L Game money if he/she deposits KRW 40,000.”

However, even if the defendant received money from the victim, he did not have the intention or ability to sell the game money.

Nevertheless, the Defendant, by deceiving the victim as above, received 40,000 won from the victim to the company bank account (O) in the name of the Defendant under the name of the victim for the same day, and acquired 324,000 won in total as the sales proceeds of game money by deceiving three victims from around that time to February 12, 2019, as shown in attached Table 2.

[2019 Highest 2604] On February 15, 2019, the Defendant posted a letter “I,” “I sell Q2 game money,” by accessing “L game site” to “P” at a place where it is not known to the head of Michuhol-gu Incheon Metropolitan City, Michuhol-gu.”
