A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a social service personnel in charge of the activity support field for disabled students at C elementary school located in Kimcheon-si B.
1. On September 18, 2017, the Defendant forged a private document: (a) entered the Defendant’s apartment D, Kimcheon-si D, 104 Dong 1101, and the Defendant’s house located in Kimcheon-si, 104 Dong 1101, absent without permission, and had the intent to forged and submit a prescription slip using a computer to search and download the prescription form on the Internet using a computer; (b) entered the prescription form in the name column, “A”, “E”, “E,” in the name column of medical personnel; (c) in the name column of the prescribed medical person; and (d) entered “G”, “G”, in the name column of prescription medicine; and (d) entered the prescription slip in the name column of the prescription medicine, “three” in the name column of the prescribed medical personnel; and (d) stored the prescription file in the above Korean language book by means of a prescription slip from around October 15, 2017 to around 10 and around 27, 2017.
Accordingly, for the purpose of uttering, the Defendant forged a prescription and a medical certificate in F’s name, which is a private document on proof of facts.
2. On October 15, 2017, the Defendant, at the above C elementary school, submitted a forged prescription to H as if he/she was a document that was aware of the forgery, and thereafter, submitted to the above H a total of 24 times during the period from November 9, 2017 as indicated in the list of crimes in the attached list of crimes.
3. Any social service personnel who violates the Military Service Act shall not desert from their service for at least eight days in total without justifiable grounds;
Nevertheless, from April 17, 2017, the Defendant was absent from office on September 19, 2017 without justifiable cause while serving as social service personnel at the above C elementary school.
