Reasons
Punishment of the crime
The defendant is the representative director of corporation E who conducts electrical construction business, etc. in Gwangju City D and 201.
The Defendant reported the performance of electrical construction to the Korea Electrical Construction Association with 58 roads 8, Gangseo-gu Seoul Airport, and reported the performance of electrical construction to the Korea Electrical Construction Association from 2010 to 2012. Nevertheless, the Defendant forged and fraudulently submitted a certificate of the performance of electrical construction of KRW 12,160,967,00 during the above period to the effect that he had had the performance of electrical construction of KRW 737,467,00 during the above period, and added the performance of the Company E’s electrical construction by obtaining the false performance certification from the Association, and did not notify the fact that he would participate in bidding related to electrical construction conducted by the Korea Electric Construction Corporation based on the performance and received construction works or that he did not know to the other party that he had the performance.
1. The act of forging a private document and the act of uttering of a falsified document on January 25, 2011;
A. On January 25, 2011, the Defendant drafted “F construction works”, “14,30,000,000” and “2,678,500,000” in the column of total contract amount in the office of the said Co., Ltd., Ltd. using a computer, and marked the name tag and seal impression of G Co., Ltd., which were newly stored at the bottom of the lower judgment.
The Defendant continued to prepare a “certificate of the performance of electrical construction works in 2010” by using re-computers, entered “H construction works”, “18,700,000” in the column of total contract amount, and “3,245,000” in the column of total amount of contract for the year, and affixed the name cards and seal impression of the said corporation G at the bottom.
Accordingly, for the purpose of uttering, the Defendant committed the above two copies of the certificate of the performance of electrical construction in the name of G Co., Ltd., a private document on rights and obligations.
