A defendant shall be punished by imprisonment for not more than ten months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. A person who intends to conduct electrical construction business violating the Electrical Construction Business Act shall register with the Special Metropolitan City Mayor, Metropolitan City Mayor, Do Governor or Special Self-Governing Province Governor having jurisdiction over the principal place

Nevertheless, the Defendant did not register the electrical construction business, and operated the electrical construction business with the trade name “C” from February 2010 to June 2016, the Defendant had been engaged in the electrical construction business from January 201 to June 2016.

2. On February 2010, the Defendant began electrical construction business with the trade name of “stock company C” in Silti City B, which used a copy of the certificate of registration of electrical construction business of “C” of “Co., Ltd., which the Defendant had previously worked, to forge and use the certificate of registration of electrical construction business of “C” of “Co., Ltd.”

On February 2, 2010, the Defendant, at the office of “C”, operated by the Defendant in Silung-si, posted the paper recorded in “C”, “A”, and “F” column in the representative column of the Co., Ltd., and copied it using a reproduction machine, in the trade name column of copy of the certificate of electrical construction business registration (registration number E) of “C”, which was previously possessed by the Defendant in Silung-si.

B. The Defendant, at the same date, at the same time and place as the foregoing paragraph (a), posted the paper recorded as “C”, “A,” and “F” in the representative column, “F” in the column of registration number, “F” in the column of registration date,” and “F” in the column of registration date, and copied the paper in the column of issuance date of the certificate by using a reproduction machine.

Accordingly, the defendant has forged two copies of the certificate of electrical construction business in the name of Gyeonggi-do Governor, an official document for the purpose of exercising.

3. Counterfeiting of forged official documents;

A. On or around February 26, 2014, the Defendant entered into an electrical construction contract for the installation of a standby power circuit at HH high schools in Bupyeong-si, Busan High School, on or around May 19, 2014, “a contract for outdoor repair works” at HH high schools in Bupyeong-si, Busan High School, and on January 16, 2015.
