A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
On March 5, 2008, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) at the central method center and completed the execution of the sentence on July 6, 2009.
1. On September 25, 2010, at around 02:30 on September 25, 2010, the Defendant habitually stolen: (a) around the first floor located underground of the D church located in Gangnam-gu Seoul Metropolitan Government, left a lock by the victim E; and (b) the Defendant divers in a lock by creshing the victim’s resident registration certificate, driver’s license, Cmat Bank’s debit card, Korean bank credit card (credit card number (F), and Samsung Card;
In other words, the victim's goods were stolen habitually.
2. Fraud;
A. On September 25, 2010, the Defendant: (a) around 03:02, at the “H” bank located on the fifth floor of the fifth floor of the building G in Jung-gu Seoul, Jung-gu, Seoul; (b) notwithstanding the fact that the Defendant was not a legitimate holder of the credit card of the bank that stolen as stipulated in paragraph (1), the Defendant presented the said credit card to the victim I as if he was a legitimate holder of the said credit card; (c) deceiving the victim; and (d) issued the said 14 km gold 1.65 g of the amount of KRW 1.6 million from the victim.
B. On September 25, 2010, around 03:09, the Defendant presented the said credit card to K as if the said credit card was a legitimate holder of the said credit card, despite the fact that the Defendant was not a legitimate holder of the said credit card, at around 203:03, the second floor underground floor of the building in Jung-gu Seoul, Jung-gu, Seoul, and was issued cosmetics equivalent to KRW 136,00 from the victim.

On September 25, 2010, the Defendant: (a) presented the said credit card to the Defendant as if he was a lawful holder of the said credit card, despite the fact that the Defendant was not a lawful holder of the said credit card, at around 03:19, in the “M” store located in Jung-gu Seoul Metropolitan Government L Building 6th 83, 201.
