A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A theft Defendant: (a) around 17:00 on January 10, 202, at the residential suspender of the victim C located in the petition-gu, Cheongju-si, Cheongju-si; (b) on the part of the victim C, one wall owned by the victim damaged by the victim; (c) one cash of KRW 400,000,000, one certificate of resident registration; and (d) one credit card of Nonghyup.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On January 13, 2020, the Defendant: (a) around December 12:31, 2020, the D department store loyalty store (E store) store in Seo-gu, Seo-gu, Seo-gu; (b) was conducted as if the Defendant had no intent or ability to normally pay the price in the D department store “E store” store; and (c) had the Victim G prepare sales slips by presenting the said credit card to the victim G; and (d) was issued by the victim the 638,000,000, market price of KRW 1,000 from the victim.
B. On January 13, 2020, the Defendant: (a) around 12:46 on January 13, 2020,: (b) was engaged in as if the Defendant had no intent or ability to pay the price normally at the H “H” store in the said D department store; (c) was as if the Plaintiff was the lawful holder of the agricultural credit card that was stolen, as described in paragraph (1), and had the victim, presented the said credit card to the victim’s name and defective holder, thereby having the victim prepare sales slips; and (d) was issued one set of 394,200 won at the market price from the victim.
Accordingly, the Defendant, by deceiving victims, received property, and used stolen credit cards.
3. On January 16, 2020, the Defendant attempted to commit fraud, even though he did not have the intent or ability to pay the price normally at the J convenience store operated by the victim of the name in Ma on 13:57 on 16, 2020, the Defendant was committed as if he was a legitimate holder of the agricultural credit card that stolen, as described in the foregoing paragraph (1), and presented the said credit card to the victim, and the market price from the victim is five.
