A, B는 2012. 12. 17. 08:25경 구미시 E에 있는 F 식당 앞 도로에서, 피고인 A가 길을 지나다가 피해자 G(24세)과 어깨를 부딪힌 일로 시비가 되자 이에 화가 나, 피해자에게 “죄송하다고만 하면 되나, 눈 깔아야지”라고 말하며 주먹으로 피해자의 얼굴을 수회 때리고 발로 피해자의 몸과 다리 등을 약 10회 가량 걷어차고, 그 옆에 있던 피고인 B는 주먹으로 피해자의 얼굴을 수회 때리고 발로 피해자의 다리 등을 수회 걷어찼다.

계속하여 피고인 A는 위 G의 일행인 피해자 H(29세)이 자신을 말리려고 하자 피해자에게 “니는 뭔데”라고 말하며 주먹과 발로 피해자의 얼굴, 몸통을 약 5~6회 정도 때려 땅바닥에 쓰러지게 한 다음 발로 피해자의 얼굴을 2회 걷어차고, 피고인 C은 오른쪽 무릎으로 피해자의 머리를 4회 정도 걷어차고, 피고인 B는 발로 피해자의 얼굴을 1회 걷어찼다.
