A은 2014. 7. 23. 01:48경 고양시 일산동구 C에 있는 ‘D’ 주점 흡연실에서 피해자 E(23세)이 피고인 A의 주민등록상 나이가 피해자보다 1살 더 어리다며 무시한다는 이유로 시비를 하던 중 화가 나 주먹으로 피해자의 얼굴을 수차례 때리고 발로 피해자의 하체를 걷어차 바닥에 넘어뜨린 후 발로 피해자의 얼굴을 걷어차고 손으로 피해자의 몸을 눌러 일어나지 못하도록 하고, 이에 가세하여 피고인 B는 발로 넘어져 있는 피해자의 얼굴을 수차례 걷어차고, 피해자가 일어서자 피고인 A이 뒤에서 피해자의 상체를 붙잡아 움직이지 못하게 한 후, 피고인 B가 주먹과 팔꿈치로 피해자의 얼굴, 몸 등을 수차례 때리고, 피고인 A은 상의를 벗어 상반신에 새겨진 문신을 드러내 보이며 주먹으로 피해자의 얼굴을 수차례 때리고 발로 피해자의 하체를 걷어찼다.
