A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal record] On August 25, 2008, the Defendant received a summary order of KRW 500,000,000 as a fine for larceny from the same court on February 29, 2012, from the Jinwon District Court's Jinwon District Court's Jinju branch, the Defendant was sentenced to a summary order of KRW 500,000 as a fine for larceny. On October 17, 2012, the Defendant was sentenced to suspension of indictment for larceny at the Jinwon District Prosecutors' Office.

[2014 Highest 1074] On June 19, 2014, the Defendant: (a) was at the warehouse of the Seodaemun-gu Eup office located in Jinju-ro, Seoul Special Metropolitan City, 587, Dong-ro, 2014; (b) prior to the fact that the said Eup office provides public services and keeps the keys of the warehouse in the window; and (c) the victim C was parked in the warehouse; (d) he opened the said warehouse using the warehouse heat and intruded the said warehouse into the warehouse; and (e) operated a D 200,000 Simb, a market price owned by the victim.

Accordingly, the defendant habitually stolen the victim's property.

1. At around 19:00 on January 20, 2015, the Defendant: (a) was parked in the sports-wave parking lot located in Seocho-gu Seoul Special Metropolitan City, Chungcheongnam-do; (b) opened a door of the said car that was not corrected; (c) opened the door to the victim’s occupation; and (d) cut off one wall of KRW 180,000 at the market price, including one driver’s license and one nHH agricultural debit card, which is owned by the victim, from the spread of the victim’s occupation.

Accordingly, the defendant habitually stolen the victim's property.

2. Fraud or violation of the Specialized Credit Finance Business Act;

A. On January 20, 2015, the Defendant, at the G convenience store located in Jinju City F, around 22:57, by deceiving the victim by using the following methods: (a) purchasing one hamberger from the victim H, an employee, for the payment of the purchase price; (b) presenting the stolen EF debit card; and signing the sales slip; and (c) signing the sales slip.
