Punishment of the crime
[criminal record] The defendant was issued a juvenile protective order at the Jinwon District Prosecutors' Office on February 10, 201 through special larceny on March 31, 201; the juvenile protective order was issued on July 29, 201 through larceny; on April 24, 2013, the Busan District Court issued a summary order of two million won by larceny, etc.; and on February 12, 2015, the defendant was sentenced to a suspended sentence of eight months by imprisonment with prison labor at the Busan District Court for larceny.
【Criminal Facts】
1. The Defendant habitually stolen, around 03:00 on February 20, 2015, found the GM5 car owned by the victim D, which was parked in the Felon in the front of the Pelon city of Jinju, and opened a door-to-face not corrected by the rear seat of the said car, and opened a new card owned by the victim and one driver’s license kept in the said door-to-face. From around that time to May 26, 2015, the Defendant stolen the total amount of KRW 10,087,000, total of seven property owned by the victim, including the list of crimes (1).
2. Around 10:51 on May 26, 2015, the Defendant, at the time of Jinju, driven an I driver’s vehicle, which was stolen, without obtaining a driver’s license, at approximately 50 meters section of the 90-1st road at the time of Jinju.
3. Fraud and the Defendant violated the Specialized Credit Financial Business Act: (a) settled the amount equivalent to KRW 8,200,00, such as bathing costs, at the L bath operated by the K Victim located in J on May 8, 2015; (b) presented one copy of the NH NowC card in the name of M, which was stolen under paragraph (1) 3, and issued after signing the sales slip; and (c) used a stolen debit card by issuing it after signing the sales slip; (b) from around that time to May 12:36, 2015, the Defendant believed that the above debit card is genuine, the Defendant acquired financial benefits equivalent to KRW 8,200 from the victim; and (c) used the stolen debit card more than six times in total as indicated in the list of crimes (2) in the same manner from around that time to May 12:36, 200.
